1. Customers are required to use all rented items with due care and take reasonable measures to prevent damage. Customers understand and accept the potential risks of using rented items. They release SONORAN SKY EVENTS LLC from liability for any related injuries or damages.
2. Customers receive items in their current condition and should check them before use. They confirm receipt of items in good working order.
3. Prices are for a 1 day or 1 event charge. We offer multiple day, weekly, and monthly rates upon request. All prices are subject to change without notice.
4. If bad weather is present the day of the event (heavy rain above 50% or high wind above 15mph) SONORAN SKY EVENTS LLC will consider refunding money for tent rental. Our bad weather policy does not apply to indoor events or rental items not affected by the weather.
5. No store credit or refund will be provided if the event is canceled within 24 hours of the delivery window or if items are loaded on the truck for delivery.
6. Any equipment not returned by the due date will be charged a late fee of 50% of rented items. If not returned within seven (7) days after your event, renter will be billed the full replacement cost, no exceptions.
7. For deliveries, set up and take down is not included but can be negotiated based on availability.
8. If a tent is rented, all items associated with the rental must be delivered by Sonoran Sky Events LLC. Customers may not pick up or self-deliver tents. It is the sole responsibility of Sonoran Sky Events LLC to set up and take down tents. Customers are strictly prohibited from attempting to set up or take down tents.
9. For delivery, area needs to be easily accessible to our trucks. All equipment is dropped off in stacks as close to your requested area as can be reached with our delivery vehicle. Delivery location must be on the first floor. Additional distances, steps, elevators, etc. will be subject to additional charges.
10. Chairs need to be stacked neatly before pick up.
11. If items are lost, stolen, or damaged, renter will assume theft or loss while in possession of renter.
12. Please do not return equipment dirty (food, drinks, etc. spilled and not wiped up from tables or chairs). If returned dirty, renter will be charged an additional fee.
13. For linen rental, please shake out and air-dry linens. Linens should be free of waste and dry to prevent staining and mildew. ANY LINEN WITH BURNS, TEARS OR CANDLE WAX DAMAGE WILL BE CHARGED THE COST OF THE LINEN. Laundry bags are provided with linen orders; please return them in those containers.
Rental Agreement
1. INDEMNITY/HOLD HARMLESS: Customers will take all necessary precautions regarding the items rented, and protect all persons and property from injury or damage. Customer agrees to indemnify, defend and hold harmless SONORAN SKY EVENTS LLC from and against any and all liability, claims, judgments, attorneys fees and costs of every kind and nature, including but not limited to, injuries or death to persons and damage to property, arising out of the use, maintenance, instruction, operation, possession, ownership or rental of the items rented, however caused, except claims or litigation arising through the sole gross negligence or willful misconduct of SONORAN SKY EVENTS LLC.
2. ASSUMPTION OF RISK/RELEASE: Customer is fully aware and acknowledges there is a risk of injury or damage arising out of the use or operation of the items rented and hereby elects to voluntarily enter into this rental agreement and assume all of the above risks of injury. Customer agrees to release and discharge SONORAN SKY EVENTS LLC from any and all responsibility or liability from such injury or damage.
3. RECEIPT/INSPECTION OF RENTAL ITEMS: Customers hire the rental items on an "as is" basis. Customer acknowledges that he has, or will, personally inspect the rental items prior to use and finds the items suitable for customer's needs. Customer acknowledges receipt of all items listed in the Rental Agreement in good working order.
4. POSSESSION/TITLE: Customer's right to possession begins upon the rental items leaving SONORAN SKY EVENTS LLC and terminates on the Agreed Return Date. Any extension must be agreed upon in writing. Title to the rental items remains with SONORAN SKY EVENTS LLC.
5. RENTAL PERIOD/RATE/PAYMENT: If a customer makes greater use of the rental items than agreed upon, an appropriate fee for additional usage will be charged. Customer agrees to pay any collection costs or disputes arising out of this Rental Agreement.
6. PROPER CARE: Customers shall be responsible for all damage to rental items including damage due to overturning, overloading, breakage, improper use, abuse, excessive heat, or lack of cleaning.
7. COMPLIANCE WITH LAW/USE RENTAL ITEMS: Customers agree not to use rental items in any illegal manner and agree to comply with all applicable laws, ordinances and regulations. Customers are responsible for obtaining all permits and/or licenses required.
8. RETURN OF RENTAL ITEMS: Customer agrees to return rental items in good condition by the Agreed Return Date. If a teardown fee is not paid at time of booking, the Customer is responsible for dismantling all rented items before pickup. It is the sole responsibility of Sonoran Sky Events LLC to set up and take down tents. Customers are not permitted to take down or disassemble tents.
9. DISCLAIMER OF WARRANTIES: SONORAN SKY EVENTS LLC makes no warranty of merchantability or fitness for any particular use or purpose. SONORAN SKY EVENTS LLC shall not be responsible for any loss, damage or injury resulting from the operation, use or failure of rental items.
10. SUB-RENTAL: Customer agrees not to sublet, loan or assign the rental items.
11. DEFAULT: Should customers fail to comply with any provision of this Rental Agreement, SONORAN SKY EVENTS LLC may terminate the agreement and retake the rental items.
12. RETAKING OF RENTAL ITEMS: Customer authorizes SONORAN SKY EVENTS LLC to retake rental items without notice or further legal process if necessary.
13. LEGAL FEES: If an attorney is retained and SONORAN SKY EVENTS LLC is the prevailing party, the customer shall pay reasonable attorney's fees and court costs.
14. PAYMENT FOR LOSS OR DAMAGE: Customers will be totally responsible for all lost and/or damaged rental items. Damaged items will be held for seven days for customer inspection. Customer authorizes SONORAN SKY EVENTS LLC to charge the card on file for any damages.
15. NOTICE OF NON-WAIVER/SEVERABILITY: Any failure to insist upon strict performance shall not be interpreted as a waiver of any other provision of this Rental Agreement.
16. MOVING OF NON-RENTAL ITEMS: SONORAN SKY EVENTS LLC is not liable for any damage arising from customer-requested moving of non-rental items.
17. MARKING UNDERGROUND UTILITIES: Customers are solely responsible for marking all underground utilities prior to the arrival of SONORAN SKY EVENTS LLC when set up requiring digging and staking is involved.
18. LATE CHARGES: A late fee of 50% per day of rented items will be assessed per day up to 7 days. Any items not returned after 7 days will be billed at full replacement cost, no exceptions.
19. COLLECTION: All expenses incurred by Owner in the collection of amounts due, including attorneys' fees and administrative fees, shall be paid by Customer.
20. PAYMENT AUTHORIZATION: If a credit or debit card has been presented, renter authorizes the owner to submit for payment all amounts owed under this agreement.
21. CANCELLATION POLICY: Deposit will be forfeited if reservation is canceled 3 days prior to event. No store credit or refund will be provided if canceled within 24 hours of the delivery window. There are no refunds on any "unused" equipment.
22. PAYMENT DUE POLICY: Final payment is due upon delivery or at the time of customer pickup. No items will be released until full payment is received.
23. PICK UP POLICY: If a customer elects to pick up rental items, a pick up date and time window will be agreed upon. SONORAN SKY EVENTS LLC will not be responsible if the customer fails to pick up within the specified window or does not have an appropriate vehicle.
24. PHOTO RELEASE POLICY: Unless notified otherwise in writing, the customer agrees that SONORAN SKY EVENTS LLC may publicly use photographs taken at their event for the purpose of promoting the business. No royalty, fee, or other compensation will be payable to the customer.
